The Supreme Court today referred to a five-judge constitution bench, the plea accusing Whatsapp and Facebook of privacy violation and linking Whatsapp data with Facebook.

scA bench, headed by Chief Justice JS Khehar, said the five-judge bench will decide on the broader questions to be adjudicated and it will hear the matter on the 18th of this month.

The apex court was hearing the petition filed against the change in Whatsapp privacy policy seeking to share information of users with Facebook. The petition had said, in August last year, Whatsapp suddenly announced a change in its privacy policy and users were asked to agree to the new privacy policy which sought to share users’ entire information including phone number, contacts and data with social networking site Facebook.

Earlier, the Delhi High Court had refused to interfere in the matter and allowed WhatsApp to go ahead with its data sharing policy with Facebook. The High Court, however, told WhatsApp that data of any user who deletes his/her instant messaging account before September 25th must be deleted from WhatsApp servers.
