Welfare Party of India welcomes the much awaited verdict of the Supreme Court to uphold the Minority Status of Aligarh Muslim University however the ruling created confusion by referring it to a 3 judge bench.

Leaving it to a three judge bench to determine afresh the minority status of AMU, it creates confusion and remains inconclusive, says National President of Welfare Party of India, Dr Raisuddin Baidya

He appreciated the Apex court’s judgment to give minority status to the historical “Aligarh Muslim University “and said it has also specifically laid down a ‘holistic and realistic’ test to determine the ‘minority character’ of an educational institution.

He said, “This verdict has once again reinstated the faith of Muslim citizens in the judiciary of our country which upheld in all its wisdom the 4:3 majority verdict which overruled the 1967 judgment that claimed that the university cannot be considered a minority institution since it was created by a central law.

He said, “The Supreme Court had upheld the constitutional provisions enshrined in Article 30(1), which affirmed that all minorities including Muslims have the right to establish and administer educational institutions of their choice”.

Dr Baidya, applauded the highest Court for rightfully considering the two aspects in its judgment, one on the genesis or origin of the minority institution, which was established by a Muslim “Sir Syed Ahmad” and the purpose of establishing the institution to “predominantly” benefit of the Muslim Minority Community, which both qualify in this case of “Aligarh Muslim University”.

However by leaving it to a three judge bench to determine afresh the minority status of AMU, it creates confusion and remains inconclusive.
