Disqualification Case: 20 AAP MLAs move HC challenging EC’s decision


All the 20 Aam Aadmi Party MLAs have moved Delhi high court challenging the Election Commission’s decision to dismiss their plea in connection with the ongoing office of profit case.

These MLAs have challenged the EC’s July 17 order rejecting their demand to cross original petitioner Prashant Patel.

Through his petition, Mr Patel sought disqualification of 20 AAP MLAs on the ground that they violated the office of profit rule, while working as parliamentary secretaries in Delhi government.

In March 2018, high court had set aside the finding of EC to disqualify the AAP MLAs for allegedly holding offices of profit and held that the notification disqualifying them was bad in law, since there was a violation of natural justice and no oral hearing was given to the lawmakers before disqualifying them. High Court had remanded their plea back to the EC, asking it to hear it afresh.

The Election Commission on July 17 also rejected the MLAs plea to summon officials of Delhi government for cross-examination on the documents they sent to EC in connection with the case.
