The Uttarakhand High Court in Nainital today dismissed the petition filed by the rebel Congress MLAs in Uttarakhand. They had prayed for extension of a week’s time given to them for filing a reply to the show cause notice issued by the State Assembly Speaker. The deadline for their reply to the Speaker’s show cause expires tomorrow evening.
Out of the 9 rebel MLAs, 8 MLAs had filed the petition with the exception of Vijay Bahuguna. Hearing the matter, Justice Sudhanshu Dhulia dismissed the petition saying that it was baseless and not maintainable.
He asked the petitioners to put their plea before the Speaker who is yet to give his decision on the notices. Senior advocate Kapil Sibbal appeared in the Court on behalf of the State Government, while Rakesh Dwivedi pleaded for the rebel MLAs.
Nine rebel Congress MLAs today filed a petition in Nainital High Court challenging the show cause notice issued to them by State Legislative Assembly Speaker.
Speaker Govind Singh Kunjwal had issued show cause notice to the nine Congress MLAs who opposing their own government in the Assembly stood with 27 BJP MLAs and met the Governor KK Paul at Raj Bhavan, seeking the dismissal of Harish Rawat led Government.
The Speaker has given the 9 Congress MLAs time till tomorrow to respond as to why their assembly membership be not terminated under the provision of the anti defection law.
