Bihar government will reinforced liquor ban Act in the state on Sunday. A special cabinet is underway in this regard under the chairmanship of Chief Minister Nitish Kumar.
Sources said the cabinet is likely to approve the Bihar Excise and Prohibition Act 2016 and total liquor ban will continue in the state.
Principal Additional Advocate General Lalit Kishore told AIR the Patna High Court order has termed only one section of the previous Act ultra vires.
It does not say anything about the revised Act passed by both Houses of the state legislature.
He made it clear that the High Court order would not impact the new Act. It may be noted that the Patna High court had on Friday struck down the state’s Prohibition of Liquor Act which banned the consumption of Indian Made Foreign Liquor.
Quashing the April 5 notification,a division bench comprising Chief Justice Iqbal Ahmad Ansari and Justice Navniti Prasad Singh termed the prohibition illegal and ultra vires.
