The Supreme Court today issued notice to the Centre on a petition by four NGOs, which had challenged the constitutional validity of fresh promulgation of Land Acquisition Ordinance by the government. A bench of Justices J S Khehar and S A Bobde, asked the government to file the reply within four weeks.
The bench however, declined to stay the operation of the ordinance, saying it would first want to examine the stand of the government in the matter.
Four NGOs last Thursday had moved a PIL alleging that re-promulgation of the ordinance entered the impermissible domain of enacting a legislation.
The PIL said as the Ordinance was first promulgated in December 2013, the government should have introduced a bill on the line of the ordinance to amend the Land Acquisition Act 2013, in the Parliament Session that followed. However, instead of following the constitutionally dictated procedure, the government re-promulgated the ordinance after the session.
