The Patna High Court today rejected two PILs challenging formation of Nitish Kumar led government in Bihar. A bench comprising Chief Justice Rajendra Menon and Justice A K Upadhyay delivered this judgement after hearing the PILs which were filed against the Governor’s decision not to invite RJD, the single largest party to form Government.
The PILs were filed last Friday soon after JD(U) party chief Nitish Kumar was sworn in as the chief minister with the support of BJP. Mr. Kumar joined the NDA along with 71 legislators and claimed support of 132 MLAs in the 243 member house. RJD has the strength of 80 MLAs in the Assembly.
PIL was filled by RJD MLAs Saroj Yadav and Chandan Kumar seeking quashing of the oath administered to the Chief Minister.The other PIL of the same nature was filed by mukhia Jitendra Kumar, who holds allegiance to Samajwadi Party.
