Supreme Court today ruled that RJD chief Lalu Prasad Yadav will  face Trial For Criminal Conspiracy in fodder scam case.

Lalu has already been convicted in one of the fodder scam cases and his appeal against I’d pending in the Supremo Court.

Setting aside the High Court order which said that since Lalu has already been convicted in one fodder scam case there was no need to hold trial in other similarly placed cases, the bench of Justice Arun Mishra and Justice Amitava Roy today held that the trial would take place in all the cases on all the charges and directed their completion in nine months time.

Setting aside the High Court order, the court in its judgment wondered how could the same judge on the same facts of the case takes one view in respect of one accuses and takes a contrary view in case of Lalu Prasad Yadav.

Holding that the High Court order in case of Rajasthan was on “soundbasis”, Justice Mishra speaking for the bench said that the consistency is the hallmark of the judicial pronouncement and wonderland how could there be “different view in respect of different people on some facts.”

 

In 2014, the Jharkhand High Court had given relief to the former Bihar Chief Minister and others by dropping charges of criminal conspiracy, criminal breach of trust and prevention of corruption.

The court had quashed the cases on the grounds that a person convicted in one case could not be tried in similar cases based on same witnesses and evidences.

However, the CBI had contended that though the cases have arisen from fodder scam, they are different in nature as different amounts were involved from different treasuries.
