Uttarakhand High Court today stayed the floor test in the assembly scheduled for tomorrow.The court adjourned the hearing of the case till April 6. The court observed that several legal issues have to be considered.

Appearing on behalf of the Centre, Attorney General Mukul Rohtagi argued that the yesterday’s court order on directing a floor test amounted to suspending presidential proclamation. He said, no purpose would be served by a floor test as there was no government in place.

The Centre and Uttarakhand rebel Congress MLAs moved the High Court challenging an interim order by a single bench directing a floor test in the Assembly tomorrow, days after President’s Rule was imposed in the state. A petition was mentioned before a division bench of the high court comprising Chief Justice K M Joseph and Justice V K Bisht by Mr Rohatgi.

Rebel Congress MLAs had moved the High Court challenging their disqualification by Uttarakhand Assembly Speaker Govind Singh Kunjwal.

The petition sought clarity on whether the floor test can be held in the state Assembly after the promulgation of President’s rule when the House is in suspended animation.
