The National Company Law Appellate (NCLAT) on Wednesday upheld the Competition Commission of India’s (CCI) Android dominance order against Google. The tribunal has upheld the penalty of 1338 crore rupees imposed by CCI.
The Competition Commission of India (CCI) had last year, on October 20, imposed a fine on Google for anti-competitive practices in relation to Android mobile devices. Google challenged this ruling before the National Company Law Appellate Tribunal (NCLAT), which is an appellate authority over the orders passed by the CCI.
The anti-trust appellate tribunal has held that the CCI’s order does not suffer from any confirmation bias. Furthermore, the NCLAT has held that Google asking the Original Equipment Manufacturers (OEMs) to pre-install the entire Google Suite of 11 applications amounts to imposition of unfair conditions. The regulator also ordered the Internet major to stop indulging in various unfair business practices.
Google has been given 30 days to pay the penalty and implement the order. The tech giant can now challenge the order in the Supreme Court.
