In a significant setback to Opposition parties led by the Trinamool Congress and its INDIA bloc partners, both the Chairman of the Rajya Sabha and the Speaker of the Lok Sabha have rejected motions seeking the removal of Chief Election Commissioner Shri Gyanesh Kumar.

The notices of motion, submitted on March 12, 2026, invoked Article 324(5) read with Article 124(4) of the Constitution, along with provisions of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, and the Judges (Inquiry) Act, 1968.

After a “careful and objective assessment” of all relevant aspects, the presiding officers declined to admit the motions, exercising powers vested in them under Section 3 of the Judges (Inquiry) Act, 1968.

With the rejection by both Houses, the Opposition’s attempt to initiate formal proceedings for the removal of the Chief Election Commissioner has effectively been halted at the preliminary stage.

The decision was formally communicated to Members by Rajya Sabha Secretary-General P. C. Mody and Lok Sabha Secretary-General Utpal Kumar Singh.
