Malhotra criticises Delhi Government

Prof. Malhotra said it is clearly not the interest of the Sheila Government to provide quality services to its residents through a decentralisation process but instead try and capture the corporation and run it like a fiefdom.

It is worth noting that the Constitution was amended to specifically ensure the independence of the corporation and municipal councils from State interference and allow the tenets of local self Government to take root.  It is a contradiction in terms that while the Congress is always happy to credit the late Rajiv Gandhi for this, the Delhi Government is moving to strangle the spirit of the amendment by overriding the clause, and take control of the MCD.

According to the constitution, slums, street lighting, water, electricity, roads, bridges, fire service & land use etc. all normally fall within the authority of the municipal corporations and the attempt by the Delhi Government to progressively dispossess the MCD of its authority is patently unconstitutional.

The Central Government is not willing to give Delhi full statehood and neither is it willing to hand over the DDA, Police, Land and Law & Order responsibilities to the Delhi Government. Mrs. Sheila Dikshit is not even making a case for the transfer of these duties.  If Delhi is a centrally administered region, then how can the Delhi Government lawfully be allowed the rights that only the Central Government enjoys.

Prof. Malhotra said that for complete and all round development of Delhi, the BJP demands that before trifurcation of MCD Government should ensure: full statehood for Delhi,        invocation of the rights provided by constitution to municipal authorities, return of the powers of the MCD that have been arrogated by the Delhi Govt. to itself and provide for a system of a Mayor-in-Council.
